The petitioner, who stands acquitted in case FIR No.107 dated 23.05.2018 under Sections 21 and 29 of NDPS Act registered at P.S Chheharta District Amritsar, vide order dated 16.02.2024, has filed the present petition under Section 528 of BNSS, praying therein for issuance of appropriate directions to respondent Nos. 2 and 3 to conduct a fair and impartial investigation into the incident alleged to have occurred at about 1:00 p.m. on 16.02.2026 in which respondent No. 4 assaulted him (P).

Learned counsel for the petitioner submits that respondent No. 4, a police official serving in the Punjab Police, has been continuously harassing the petitioner, and is misusing his official position by threatening to falsely implicate the petitioner in false case. Despite an untoward incident having occurred on 16.02.2026, in which the petitioner was allegedly assaulted, a representation was submitted to the competent authorities concerned by the petitioner but the same remains undecided to date.

On a query put to learned counsel as to whether the petitioner got himself medico-legally examined after the alleged assault, no satisfactory response MANOJ KUMAR 2026.03.23 21:13 I attest to the accuracy and authenticity of this order is forthcoming.

CRM-M-15521-2026 Learned counsel, at this stage, restricts his prayer to direct the official respondents to decide the representation dated 17.02.2026 (Annexure P.4) moved by the petitioner in time bound manner.

On the asking of the Court, Mr. Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of respondents No.1 to 4-State. 6.

In view of the limited prayer made by learned counsel for the petitioner and, without commenting on the merits of the case, the present petition is disposed of with direction to the Deputy Superintendent of Police, Amritsar concerned to consider and decide the representation dated 17.02.2026 (Annexure P.4), expeditiously, preferably within a period of four weeks, in accordance with law.
