"#$ !% Allegations against the petitioner Bhola Singh in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.33 dated 27.05.2015 registered at Police Station Jourkian, District Mansa under Section 22/61/85 of Narcotic Drugs and Psychotropic Substances Act, 1985, are that he was found in illegal possession of 400 tablets of Alprazolam, a non:commercial quantity. Contentions of the learned counsel for the petitioner Mr.L.S. 27.05.2015 and that investigation and the trial will take a long time to conclude could not be controverted by learned State counsel. In view of the fact as has been contended by learned State counsel being a case of non:commercial quantity, and the incarceration already undergone by the petitioner impels this Court to allow the prayer. Accordingly, the petitioner is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate.
