LISA GILL, J. (Oral) The petitioner seeks the concession of anticipatory bail in FIR No.56 dated 25.04.2017 under Sections 323, 325, 341, 354, 148, 149 IPC registered at Police Station Sadar, Phagwara, District Kapurthala. It is reitereated that civil litigation between the parties is pending. Reference is made to a copy of suit for specific performance by the petitioner's wife (Annexure P1) and interim order dated 05.12.2016 (Annexure P2) passed in the said case. Possession of the property in question, it is submitted, was in fact with the petitioner's wife. The petitioner is a 65 year old man who has been falsely implicated in this case. The petitioner, it is submitted, has since joined investigation. Therefore, this petition be allowed.

Crl. Misc. No. M-31843 of 2017 [ 2 ] indeed joined investigation pursuant to interim orders passed by this Court and his custodial interrogation is not required. Learned counsel is unable to deny the pendency of civil litigation between the parties. The petitioner is not reported to be involved in any other criminal case. There is no allegation that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts before the learned trial Court, if released on bail.
Keeping in view the facts and circumstances of the case but without expressing any opinion on the merits of the case, it is considered just and expedient to allow this petition. Consequently, order dated 30.08.2017 is made absolute.
None of the observations made here-in-above shall be construed to be a reflection on merits of the case and shall have no bearing on trial.
