Present:

Mr. Aman Dhir, Advocate for the petitioner.

Mr. Sarabjit Singh, AAG, Punjab.

HARINDER SINGH SIDHU, J Crl.M.No.21112 of 2021 Prayer is for preponing the date of hearing.

Notice of the application.

Sh. Sarabjit Singh, AAG, Punjab accepts notice on behalf of respondent-State of Punjab.

Heard.

For the reasons recorded in the application, which is supported by an affidavit, the same is allowed and the matter is taken up for hearing today itself.

Main case Prayer is for grant of regular bail in case FIR No.009 dated 15.01.2019 under Sections 307,148,149,506 IPC and Section 25/27 of the Arms Act registered at Police Station Dugri, District Police Commissionerate Ludhiana.

FIR was lodged on the complaint of one Satwinder Singh, who stated that on 14.01.2019 at about 11.00 p.m, he was present outside his house. He saw Amandeep Singh @ Assa, Jaskaran Singh @ Jassa (petitioner), Bandhu Mann Singh, Armaan Sidhu and Bikramveer Singh MANOJ KUMAR 2021.07.27 10:05 I attest to the accuracy and integrity of this document

CRM-M-20610 of 2021 (O&M) #2# along with 5-6 unknown persons standing there. They started firing at the complainant. The complainant managed to save himself but meanwhile nephew of the complainant reached there. The assailants also fired at nephew of the complainant but he was able to escape by moving aside. Gunshot fired by them hit on the gate and walls of the house. Amandeep Singh @ Assa fired at the complainant which narrowingly missed and passed over his head. On noise being raised, persons gathered there and the assailants fled the spot.

Learned counsel for the petitioner submits that it is a case of no injury and that the matter has since been compromised between the parties. Challan qua three of co-accused has already been filed. The petitioner was earlier declared P.O, though he was thereafter arrested on 03.03.2021 and is in custody since then.

Without commenting anything on the merits of the case and also bearing in mind the fact that it is a case of no injury and that the matter has been compromised between the parties, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Jaskaran Singh is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.

This present petition stands accepted accordingly. July 26, 2021 (Harinder Singh Sidhu) manoj Judge Whether speaking/reasoned: Yes/No Whether Reportable: Yes/No MANOJ KUMAR 2021.07.27 10:05 I attest to the accuracy and integrity of this document
