**** GURBIR SINGH , J. (ORAL) CRM-16647-2023 This is an application under Section 482 of Cr.P.C. for placing on record the Annexure P-6 and exemption from filing the certified/true typed copies of the same.

For the reasons stated in the application, the same is allowed. Annexure P-6 is taken on record.

CRM-M-17691-2023 (O&M) The prayer in the present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case bearing FIR No.0046, dated 14.03.2022, under Section 379-B (2) of IPC, 1860 registered at Police Station Sultanpur Lodhi, District Kapurthala (Annexure P-1). Learned counsel for the petitioner submits that the petitioner was granted regular bail vide order dated 14.03.2022 passed by learned trial Court and thereafter he was regularly appearing before the trial court on each and every date of hearing except on 18.03.2023 (Annexure P-4) due to deteriorating health. 2023:PHHC:060314 CRM-M-17691-2023 (O&M) -2Learned trial Court had cancelled the bail orders. Bail bonds and surety bonds were forfeited to the state. Non-bailable warrant of arrest was issued on 05.04.2023. The absence of the petitioner was unintentional. Learned counsel for the petitioner further submits that the similarly situated co-accused was also granted relief by the Co-ordinate Bench of this Court in CRM-M-16223-2023 (O&M) vide order dated 29.03.2023.

Notice of motion.

At the asking of the Court, Ms. Himani Arora, AAG, Punjab, appears and accepts notice on behalf of respondent No.1-State. A copy of the paper book be supplied to her during the course of the day. The absence of the petitioner cannot be considered as intentional as has immediately rushed to the Court to put appearance before the trial Court. The purpose of bail is to secure the presence of the accused. The petitioner is directed to surrender before the trial Court on or before the 28.04.2023, the next date fixed by the learned trial Court and on his doing so, he shall be admitted to bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Judge concerned.

Proceedings under Section 446 Cr.P.C. shall be given logical end. Petition stands disposed of.
