**** HARNARESH SINGH GILL, J.(Oral) Through this third petition, the petitioner seeks regular bail in case bearing FIR No.92 dated 12.06.2021, registered under Section 22C of the NDPS Act, 1985, at Police Station Bassi Pathana, District Fatehgarh Sahib, the earlier two bail petitions being dismissed as withdrawn on 26.08.2021 and 01.12.2021.
There is no representation on behalf of the petitioner today. Learned State counsel submits that the recovery of 20 injections of Buprenorphine (2 ml each), is a commercial quantity and Section 37 of the NDPS Act bars the grant of bail to the accused persons in case of a commercial quantity.
In view of the stringent provisions contained under Section 37 NDPS Act, the petitioner is not entitled for the concession of bail. Above all, there is no representation on behalf of the petitioner today. Dismissed.
