*** Learned counsel for the petitioners states that Gurcharan Singh had gone abroad after joining the investigation in this case without seeking permission by the Court for the reason that there was an emergent situation on account of delivery of his daughter in law.

Learned State counsel has placed on file order passed by SDJM Nabha to the effect that no such permission was sought or granted by the trial Magistrate.

Learned counsel for the petitioners states that he be permitted to withdraw the petition qua petitioner Gurcharan Singh. Permission is granted. The petition qua petitioner Gurcharan Singh stands dismissed as withdrawn.

Learned counsel for the petitioners submits that remaining petitioners have since joined the investigation and have complied with the directions issued by this Court, therefore, they are not required for further investigation by the local police. This fact is conceded by learned State counsel on instructions from ASI Inderjit Singh. Under such circumstances, the interim bail granted to the petitioners Pawandeep Kaur, Shingara Singh, Sinder Singh and Shamsher Singh on 30.08.2017 is made absolute, subject to their fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.
