Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 56 dated 5.4.2013 under Section 307, 452, 506, 34 of the Indian Penal Code, 1860 and Section 25, 27 of the Arms Act, 1959, registered at Police Station City Gurdaspur, District Gurdaspur. Learned counsel for the petitioner has submitted that petitioner could not appear before the Trial Court on 5.6.2015 as he had gone to Delhi and could not return due to unavoidable circumstances. Petitioner had moved an application for exemption of his personal appearance but the said application was declined by the Trial Court. Absence of the petitioner before the Trial Court on 5.6.2015 was not intentional. In fact, petitioner had been regularly appearing before the Trial Court.
Accordingly, keeping in view the submissions made by the learned counsel for the petitioner, this petition is disposed of GURPREET SINGH 2015.09.22 16:07 I attest to the accuracy and authenticity of this document
