This is a petition under Section 439(2) Cr.P.C. for cancellation of the bail granted to respondent no.2.and 3.
On the instructions of ASI Gurbachan Singh, learned State counsel has pointed out that the matrimonial dispute has been amicably settled between the parties. A separate petition has been instituted by the private parties for quashing of the FIR and the statements of the parties have also been recorded by the trial Court in pursuance of the directions issued by this Court.
In view of the assertion of the learned State counsel, the petition is dismissed.
It is further clarified that in the event assertion put forth by the respondent is found to be false, the petitioner shall be at liberty to move an application for revival of the petition within a period of three months.
