******* SURINDER GUPTA, J.(Oral) Learned State counsel on instructions from Sh. Jaspal Singh, Deputy Superintendent of Police, Jalalabad submits that FIR No. 139 dated 04.11.2019 has been registered in this case at Police Station Sadar Jalalabad and the matter is under investigation.

Learned counsel for the petitioner submits that the police after two years of incident has registered the FIR but the same has been registered for offence punishable under Section 304 IPC instead of under Section 302 IPC.

Version of petitioner will be looked into by the investigating officer while proceeding further with the investigation to see as to whether offence punishable under Section 302 or 304 IPC is made out in this case. Learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to petitioner to file fresh petition, if so required.
