(Oral) The present petition has been filed under Section 439 Cr.P.C. on behalf of the petitioner-Kashmir Singh for grant of regular bail in case FIR No.54 dated 25.05.2007 registered under Sections 379, 427, 430, 506, 148 and 149 of Indian Penal Code at Police Station Qadian, Police District Batala, District Gurdaspur, Punjab. Learned counsel for the petitioner submits that the petitioner was released on regular bail and he was attending the Court proceedings regularly. The petitioner moved applications for exemption from personal appearance which were allowed by the Court. Criminal Misc. No. M-31922 of 2015 for exemption from personal appearance and bail/surety bonds of the petitioner were cancelled. Learned counsel also submits that the petitioner himself surrendered before the trial Court on 26.08.2015 and also moved an application for bail on the same day but the same was dismissed. The petitioner is in custody for the last more than one month and he is ready to abide by all terms and conditions to be imposed by this Court or by the trial Court and undertakes to appear regularly.

Learned State counsel has not disputed the submissions made by learned counsel for the petitioner.

Keeping in view the submissions made by learned counsel for the petitioner and also the fact that earlier the petitioner was released on bail and now for the last more than one month, he is in custody; he is ready to abide by all terms and conditions to be imposed by this Court or by the trial Court and also undertakes to appear regularly before the trial Court, the present petition is allowed and the petitioner (Kashmir Singh) is directed to be released on regular bail subject to furnishing bail/surety bonds to the satisfaction of the trial Court after having undertaking from the petitioner that he will attend the Court proceedings regularly.
