Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case complaint bearing No. 269 dated 17.11.2015 under Section 138 Negotiable Instruments Act, 1881. Learned counsel for the petitioner contended that petitioner was earlier admitted on bail and had been appearing regularly before the learned trial Court, but his bail was cancelled on 13.02.2019, though he had moved an application for seeking exemption from his personal appearance on medical ground. Learned counsel has placed on file a certificate (Annexure P3) indicating the fact that petitioner was under medical supervision on 13.02.2019.

Criminal Misc. No. M-20320 of 2019 In view of above, present petition stands disposed of with the directions that petitioner shall surrender before the learned Additional Sessions Judge, Bathinda within a period of one week from today and in case he moves an application for grant of bail, he shall be admitted to bail on his furnishing fresh bail bonds and surety bonds to the satisfaction of the learned lower Appellate Court.
