CWP No.8073 of 2024 -1-

IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH ***** CWP No.8073 of 2024 Date of Decision : 10.5.2024 Jyoti Narwat ..... Petitioner versus State of Haryana and others ..... Respondents CORAM: HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA Present: Mr. Dalbir Singh, Advocate, for the petitioner Ms. Tanushree Gupta, DAG, Haryana --- TRIBHUVAN DAHIYA J. (ORAL): The petition has been filed, inter alia, seeking a writ of certiorari quashing the order dated 29.8.2023, Annexure P-8, whereby the petitioner's representation seeking adjustment as Extension Lecturer has been rejected on account of her being ineligible. 2.

Learned counsel for the petitioner is not able to dispute that the petitioner is not eligible to be appointed as Extension Lecturer. He, however, contends that she is not the only one who was engaged as ineligible Extension Lecturer in the College, there are twenty others who are still working despite being ineligible and the action has been taken only against her.

3.

Learned State counsel, on instructions, submits that a few ineligible Extension Lecturers are working in the College only on account of Court protection given to them in the cases filed earlier. The Ashwani Kumar 2024.05.14 16:44 I attest to the accuracy and integrity of this document

CWP No.8073 of 2024 -2- Department is pursuing the matter and seeking vacation of the interim stay granted in their favour.

4.

This Court is of the view even if ineligible Extension Lecturers have been engaged or are working, it will not give any right to the petitioner to claim engagement since in terms of the Policy, dated 4.3.2020, only eligible persons can be engaged. The petitioner can only claim equality in law and not in derogation thereof. 5.

In view thereof, there is no ground to entertain the petition. 6.

Dismissed.
