Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.97 dated 07.08.2015 under Sections 307, 323, 341, 148 and 149 IPC, registered at Police Station Nangal, District Rupnagar.
I have heard learned counsel for the petitioner and have gone through the record.
The FIR in the present case has been got registered by Jatinder Pal Singh. As per the allegations in the FIR, on 06.08.2015, when the complainant along with Amarjit Singh and Karandeep was going on a jeep at about 10.15 P.M., then the present petitioner along with other persons came in Bolero jeep and got stopped complainant's jeep. Petitioner Satish Kumar was armed with Kirpan. He raised lalkara. CRM No.M-31975 of 2015 -2arm and also gave second blow on the back of the complainant. In view of the fact that present petitioner is named in the FIR and he was armed with deadly weapon and injuries were caused by him and in view of the fact the weapon is still to be recovered from him, I find that the petitioner is required for custodial interrogation. Keeping in view the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.
Therefore, finding no merit in the present petition, the same is dismissed.
