Quashing of FIR has been prayed for on the basis of compromise. The FIR was registered in the year 2015. Challan has not been presented.

Counsel for the complainant has put in appearance to state that the matter has been compromised.

In view of the fact that the prosecution agency has not opted to present challan against the petitioners and the matter is still under investigation, this petition can be disposed of in limine. Notice to AG Punjab. At the asking of the court, notice has been accepted by Ms. HK Athwal, DAG, Punjab. Copy given. This petition is disposed of with a direction that in case the complainant or the affected persons approach the investigating officer with supplementary statements, the said statements will be recorded, if offered voluntarily. It will be open to the investigating officer, on the basis of the said supplementary statements, to form an opinion regarding presentation of cancellation report, which will be dealt with in accordance with law by the court of competent jurisdiction.
