ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for issuance of directions to the respondents to protect the life and liberty of the petitioner and his family members.
It is submitted that the petitioner on 10.01.2012 had entered into an agreement to sell with one Rajesh son of Jai Narain resident of Nissing and later on, the said agreement was cancelled and since then, the petitioner is put under threat for involving him in some false case. It is further submitted that the petitioner earlier filed CRMM No.23405 of 2012 titled 'Kulwant Singh vs State of Haryana and others' in which following order was passed on 06.08.2012 :- "Heard.
Issue notice of motion.
At this stage, Mr. Sameer Singh, Assistant Advocate General, Haryana appears and accepts notice on behalf of respondent Nos. 1 to 6.
After hearing the learned counsel for the parties, going through the record, with their valuable assistance, considering the entire matter deeply and without Mohd. Yakub 2017.09.01 17:01 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-32014 of 2017 expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to the Superintendent of Police, Karnal (respondent No.3), to decide the representation (Annexure P-2), filed by the petitioner and to take appropriate action, in accordance with law, within a period of two months from the date of receipt of the certified copy of this order." Counsel for the petitioner further submits that on the basis of some secret information, the petitioner was again involved in FIR No.163 dated 11.05.2017 under Sections 21/29 of the NDPS Act registered at Police Station Kurukshetra and the petitioner has already been granted bail vide order dated 06.07.2017 passed in CRM-M No.22340 of 2017 titled as 'Kulwant Singh vs State of Haryana'. It is further contended by counsel for the petitioner that a representation dated 12.07.2017 (Annexure P1) submitted to the Superintendent of Police, Karnal has not been decided so far.
Heard.
This petition is disposed of with a direction to the Superintendent of Police, Karnal to look into the grievance of the petitioner and dispose of the representation (Annexure P1) expeditiously after affording an opportunity of hearing to the petitioner. However, nothing stated hereinbefore shall have any bearing on merits of the case of the aforesaid FIR registered against the petitioner.
