(ORAL) The claim pe99on had been filed under Sec9on 163A of the Motor Vehicles Act seeking compensa9on on account of death of one Dalip Singh in a motor vehicular accident which took place on account of use of Bus No.PB-03-D-1796. Learned Tribunal by way of award dated 08.03.2004 has awarded Rs.50,000/- under no fault liability. 2.
Counsel for the appellants seek enhancement submiAng that as per the amended provisions of Motor Vehicles Act, an amount of Rs.5,00,000/- is required to be given.

Perusal of the award would reveal that as per the own pleaded case of the claimants, deceased Dalip Singh was earning Rs.15,000/- per month, which far exceeds the annual income of Rs.40,000/- which is the threshold for entertaining a pe99on under Sec9on 163A of the Motor Vehicles Act.

In the circumstances, the claim pe99on itself under Sec9on 163A of the Motor Vehicles Act was not maintainable. 5.
No merits. Dismissed.
