The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/13313/2024, titled 'Atinderpal Singh Vs. Yachika', filed by the respondent-husband, pending in the Family Court, Ludhiana and she seeks transfer of the same to the Court of competent jurisdiction at Moga. It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 24.06.2021 and one girl child born from the said wedlock, who is about 3 years old, is in the care and custody of the applicant. TA-399-2025 along with her daughter, is residing at her parental place and is dependent upon her parents and has no source of earning. She has filed petition under Section 144 of BNSS, which is pending in the Courts at Moga and respondent is making appearance in the same. The distance between the two places is stated to be 75 kilometres.

Considering the very fact of the applicant, who herself has no source of earning, to be taking care of the minor child and also taking into consideration one litigation arising from the matrimonial dispute, already pending in the Courts at Moga, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/13313/2024, titled 'Atinderpal Singh Vs. Yachika', filed by the respondent-husband, stands transferred from the Family Court, Ludhiana, to the Court of competent jurisdiction at Moga. The requisite record of the aforesaid case be sent by the Family Court, Ludhiana, to the District and Sessions Judge, Moga.

Learned District and Sessions Judge, Moga, shall assign the said petition to the Family Court, Moga. Even, the parties are directed to appear before the Family Court, Moga, within a period of one month from today onwards.
