Prayer in this writ petition is for quashing of order dated 27.04.2022/29.04.2022 whereby petitioner has been transferred from Government Middle School, Singhpura, District Jind to Government Senior Secondary School, Durjanpur, Uchana, Jind, with further prayer that action be taken against respondent No. 5 on the basis of complaint (Annexure P4) submitted by the petitioner before the Block Education Officer, Safidon, Jind. Notice of motion was issued in this writ petition while noting contentions on behalf of the petitioner as under- "

It is submitted that first and foremost petitioner's transfer vide order dated 27.04.2022, was unjustified and at the behest of respondent no.5. Complaint, Annexure P-4, had been submitted by the petitioner in January 2022. It is further submitted that there is no vacant post at Government Senior Secondary School, Durjanpur, District Jind, as is evident from certificate dated RITU SHARMA 2022.05.10 11:04 I attest to the accuracy and integrity of this document

CWP-9332-2022 -230.04.2022, Annexure P-6, issued by the Principal, Government Senior Secondary School, Durjanpur (Jind). It is further submitted that petitioner in terms of Clause 4 of the transfer order, is not being permitted to rejoin at her previous place of posting by respondent no.5."

Learned counsel for the State, on instructions from Ms. Shakuntla, Superintendent, HRME 2 Branch verifies that station at Durjanpur, where petitioner has been transferred is not vacant. It is submitted that petitioner shall be permitted to rejoin at her previous place of posting at Government Middle School, Singhpura, District Jind.

In this view of the matter, no order need to be passed in this respect. Needless to say, District Education Officer, Safidon shall look into the complaint (Annexure P4) submitted by the petitioner expeditiously and necessary action, if any, be taken accordingly. Writ petition is, accordingly, disposed of.
