The grievance of the petitioner in the present petition is that no action is being taken against respondent No. 4 despite initiating the disciplinary proceedings.

The writ petitioner had made a complaint against respondent No. 4 qua her ineligibility to get the appointment as steno typist, however, it has already come on record that respondent No. 4 has already retired after attaining the age of superannuation.

Learned counsel for the petitioner submits that keeping in view the complaint filed by the petitioner, a fact finding enquiry has already been initiated by the respondent, which is not yet been completed, which is causing prejudice as no order on the complaint of the petitioner is being passed by the respondent.

Learned State counsel, on instructions of Jatinder Pal Singh, Assistant and Mr. Sanjay Kumar, Steno submits that the said fact finding enquiry will be completed within a period of two months from today. 5.

Learned counsel for the petitioner submits that in view of the statement made by learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty to revive the same in case, the undertaking given by the learned State counsel is not complied with.
