Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439 and 439-A, Cr.P.C., is for grant of interim bail to the petitioner, Sunil Rawat @ Giani, who has been booked for having committed the offences punishable under Sections 120-B, 148, 302, 420, 468 and 472 read with Section 149, IPC, and Section 25 of the Arms Act, in a case arising out of FIR No.541, dated 13.07.2013, registered at Police Station, City, Ballabgarh, District Faridabad. Learned counsel for the petitioner has confined his prayer for grant of interim bail during pendency of trial to the petitioner on the premise that he is suffering from severe chest infection.
[2] On the other hand, learned counsel for the State has pointed out that heinous crime was committed by the petitioner and his co-accused. He further points out that as many as four cases were already pending against the petitioner before registration of the present case and three cases were registered against the petitioner during his confinement in the present case and as such, his release on interim bail might be prejudicial to the interest of the prosecution. He also submits that one of the co-accused of the petitioner was granted bail by this Court and he has since been declared proclaimed offender, therefore, the petitioner might also abscond if the bail is granted.
In view of the above, learned counsel for the petitioner submits that he will not press for grant of the bail or interim bail to the petitioner at this stage but keeping in view the severe chest infection, the petitioner may be directed to get treatment at his own expenses from Metro Hospital, Faridabad. Learned counsel for the State, after taking instructions from ASI Rajinder Singh, Police Station, City, Ballabgarh, District Faridabad, has no objection to the above-said prayer of learned counsel for the petitioner.
After hearing learned counsel for the parties, the present petition is disposed of with a direction that the petitioner shall be taken to Metro Hospital, Faridabad, under jail
