 "#$ !% Allegations against the petitioner Avtar Singh alias Monu in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.91 dated 13.12.2010 registered at Police Station Hariana, District Hoshiarpur (Punjab) under Sections 307/353/186/148/149 IPC and Section 25/54/59 of the Arms Act, are that on 13.12.2010 while police was holding Naka, a Maruti car bearing registration No.CH;01H;9024 came and when it was signaled to stop, the occupants had fired at the police party.  petitioner is in custody since 22.01.2012 and was never apprehended at the spot could not be controverted by learned State counsel. Though learned State counsel has sought to oppose concession of bail to the petitioner by placing on record the list of criminal cases being faced by the petitioner, however, having regard to the total period of incarceration of the petitioner and the fact that trial is not likely to conclude in near future, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of trial Court.
