The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.80 dated 28.04.2021, under Sections 498-A/326/34 IPC (Section 304-B added later on), registered at Police Station Dehlon, District Ludhiana.

It was the case of the petitioner that she had no role, whatsoever, to play in the occurrence in question. Still further, it has been urged by the learned counsel appearing for the petitioner that the deceased, in her dying-declaration, had only alleged that the petitioner left her to burn after she had a verbal altercation with her husband. It has further been urged by the learned counsel that the petitioner was wheel-chair bound and due to her medical condition, she could not have rushed to the rescue of her deceased daughter-in-law.

Learned counsel for the petitioner states that pursuant to order dated 15.06.2021, passed by this Court, the petitioner has joined the investigation. This fact is not disputed by learned State counsel as well. MONIKA 2021.09.27 17:39 I attest to the accuracy and integrity of this document

Learned State counsel, on instructions, has apprised this Court that the custodial interrogation of the petitioner is not required. In view of the above, the petition is allowed and interim order dated 15.06.2021 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
