CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Naresh Kumar, Advocate, for the petitioner. Mr. Rohit Arya, AAG, Haryana.
***** Rajan Gupta, J. (Oral) Petitioner seeks regular bail in a case registered against him vide FIR No.90 dated 27.07.2014 under Sections 148, 149, 323, 324, 452, 307 and 506 IPC at Police Station Chhainsa, District Faridabad. On the last date of hearing, it was submitted before the court that Public Prosecutor had moved an application for clubbing of the complaint case with the trial pursuant to FIR No.90 dated 27.07.2014. However, today, an affidavit of Hanif Qureshi, IPS, Commissioner of Police, Faridabad, has been filed in court. According to the same, said application was never moved by the Public Prosecutor but by the wife of the petitioner. Under the circumstances, it is evident that the petitioner has not approached this court with clean hands. This petition is without any merit and is hereby dismissed.
Petitioner shall be liable to pay costs of Rs.10,000/- to be remitted to the Legal Services Authority, Faridabad.
