Due to the outbreak of Covid-19 pandemic, the case is taken up for hearing through video conferencing.

Instant petition has been filed under Section 438 Cr.PC for the grant of anticipatory bail in case FIR No.75 dated 03.03.2020 registered under Sections 148, 149, 323, 307 & 506 IPC and Section 25 of Arms Act, 1959 at Police Station Kalanur, District Rohtak. Learned counsel for the petitioner inter alia contends that the petitioner has been implicated in the instant case on the basis of a totally false and fabricated version; neither was he named in the FIR nor was he attributed any injury in the FIR in question. He further contends that his false implication is writ large from the fact that there was an unexplained delay of about 12 hours in lodging of the FIR. He further contends that nothing is required to be recovered from the petitioner and hence, his custodial interrogation may not be necessary. A perusal of the contents of the FIR reveals that prima facie there are serious allegations levelled against all the accused of inflicting injuries on the injured Sombir. Allegedly, the petitioner was armed with a stick whereas the co-accused had a pistol in his hand with which he fired on the stomach of the complainant.

In view of the serious allegations against the petitioner, no ground is made out to extend the extra ordinary concession of anticipatory bail to him.
