However, on hearing learned counsel for the appellants, it emerges that a suit for decree of mandatory injunc on to direct the defendants to sell one non prohibited bore pistol and one gun belonging to late Shri Jagmohan Tayal, was dismissed by the trial Court on 31.05.1997. The judgment of the trial Court was upheld by the First Appellate Court vide order dated 24.03.1998. Plain ff filed this Regular Second Appeal against the concurrent findings of the Courts below.

The sole appellant - Shri Mohan Tayal has already expired. Learned counsel for appellants/LRs of appellant submits that LRs of the appellant are not in contact with him.

In view of all the afore-said facts and circumstances, this appeal is hereby disposed of with liberty to the appellants to get it revived in case any cause of ac on s ll survives.
