CRM-M-33021-2016 The petitioner is seeking regular bail in FIR No. 40 dated 26.3.2016 registered at Police Station City-I, Malerkotla, District Sangrur under Sections 363, 366-A, 376(2) (I), 376(2) (N), 506 IPC and Section 6 of POCSO Act.

Counsel for the petitioner contends that the petitioner is in custody since 27.3.2016 and the investigation is over and challan has been presented. Counsel urges that he was not named in the statement made under Section 164 Cr.P.C. Counsel urges that an application has been filed for treating the petitioner as a juvenile.

State counsel submits that the application filed by the petitioner regarding his juvenility has been rejected.

Crl. Misc. No. M-33021 of 2016 (O&M) -2The allegations against the petitioner are that he has helped the main accused Vicky in kidnapping the victim. The trial will take time. Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
