Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.219 dated 05.06.2012 under Sections 148, 149, 302, 506 IPC and Section 25 of the Arms Act, registered at Police Station Urban Estate, Rohtak, District Rohtak. Notice of motion was issued and learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The petitioner is not required for investigation or interrogation purposes. He is simply to face trial before the trial Court. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. The petitioner has already appeared before the trial Court and has already been released on interim bail. Keeping in view the facts and circumstances of the present case and in view of the fact that petitioner has been found innocent during investigation, the present petition is allowed. The order dated 20.09.2016 granting interim bail to the petitioner is made absolute.
