Naresh Kumar Sanghi, J.(Oral) Learned proxy counsel contends that at behest of the petitioner, FIR No.555, dated 09.12.2014, for the offences punishable under Sections 406 and 420, IPC, was registered at Police Station, Sector 5, Panchkula. The investigation was entrusted to ASI Vinod Kumar (respondent No.6) who is demanding illegal gratification from the petitioner to investigate the matter. An application (Annexure P3) was presented before the Deputy Commissioner of Police, Panchkula, showing the conduct of ASI Vinod Kumar (respondent No.6) but no action was initiated against him. The petitioner has no faith in the investigation which is being carried out by ASI Vinod Kumar, therefore, the investigation be transferred from him (respondent No.6) and be entrusted to an independent SEEMA RANI 2015.09.19 13:56 I attest the accuracy and authencity of the document

At asking of the Court, Mr.Arun Luthra, AAG, Haryana, who is present in the Court, accepts notice on behalf of the respondent-State. A complete copy of the paper book has been supplied to him in the Court today.

After hearing learned counsel for the parties and going through the material available on record, the Deputy Commissioner of Police, Panchkula (respondent No.4) is directed to entrust the investigation of the present case to some other police officer posted at Police Station, Sector 5, Panchkula, who would periodically send the progress report of the investigation to Deputy Commissioner of Police, Panchkula. Disposed of accordingly.
