AJAY TEWARI, J (ORAL) Prayer is for grant of regular bail in case FIR No.149 dated 09.5.2015 under Sections 307/323/148/149 IPC and Section 27 of the Arms Act (Sections 148, 149 IPC deleted and Section 34 IPC added during challan).
Learned counsel for the petitioner contends that the petitioner has been in custody for about four and half months and the injuries attributed to the petitioner are simple in nature. Learned state counsel has accepted the assertion that the injuries were simple in nature and that the injured has been discharged from the hospital.
Without commenting upon the merits of the case and taking into account the fact that the trial shall take long time to conclude, no useful purpose would be served by keeping the petitioner behind the bars. Accordingly, the petitioner is ordered to be released on bail to the satisfaction of the CJM/Duty Magistrate, Rohtak. Petition stands allowed.
