On the last date of hearing, learned counsel for the appellant stated that he is not in touch with the appellant, therefore, notice to the appellant was ordered to be issued for today. Today, notice issued to the appellant has been received back with the report that the appellant has expired. The present regular second appeal is pending since the year 1999. Even the sole appellant has died.

In light of the above, the present appeal stands dismissed for non-prosecution with liberty to the LRs of appellant to seek its revival, in accordance with law, in case, any cogent cause of action survives. 3.
