This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 40 dated 08.07.2015 under Sections 420, 419, 467, 468, 471 & 120-B IPC at Police Station Mehal Kalan, district Barnala. Allegation against the petitioner is that he impersonated as Tejinder Singh and got executed mortgage deed in favour of Charanjit Singh and Manjit Kaur and received `14.00 lacs. According to learned counsel, petitioner is in custody for the last about 31⁄2 months. Thus, no useful purpose would be served by detaining him in custody any longer.
Learned State counsel has opposed the prayer for bail. According to him, investigation has been completed and challan presented before the competent court.
I have heard learned counsel for the parties. Keeping in view the aforesaid contentions, period of incarceration of the petitioner and the fact that case is triable by AJAY KUMAR 2015.10.30 15:31 I attest to the accuracy and authenticity of this document
CRM M-32189 of 2015 Magistrate, I am of the considered view that that no useful purpose would be served by detaining him in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Barnala.
