NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Gajjan Singh, son of Virsa Singh, resident of village Haruwal, Tehsil Dera Baba Nanak, District Gurdaspur, who has been booked for having committed the offences punishable under Section 61 of the Excise Act and Sections 186, 332 and 353 read with Section 34, IPC, in a case arising out of FIR No. 54, dated 31.8.2015, registered at Police Station, Dera Baba Nanak, Police District Batala, District Gurdaspur.

Learned counsel contends that if the alleged incident of causing injuries to the Police Cop had allegedly taken place on 31.8.2015, then there was no plausible reason with the police PRASHANT KAPOOR 2015.09.21 17:44 I attest to the accuracy and authenticity of this document

CRM-M-32223-2015 to record the DDR in that respect on 1.9.2015; the petitioner has been falsely implicated in the present case; and that two coaccused of the petitioner, from where the running still was found, were arrested and granted bail by learned Court below. I have heard learned counsel for the petitioner and with his able assistance perused the material available on record.

As per allegations, on secret information the police raided the house where the petitioner and his co-accused were distilling illicit liquor from a running still. On seeing the police party, the petitioner and one of his co-accused run away from the spot. The police dismantled the running still and recovered illicit liquor. When the police party was returning from the spot, then the petitioner caused as many as five injuries to the Police Cop. No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
