*** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.254 dated 28.11.2016, registered under Sections 324, 323, 34 IPC (Section 326 IPC added later on), at Police Station Sadar Ferozepur, District Ferozepur (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise/affidavit dated 12.07.2018 (P-2).
Pursuant to orders dated 06.08.2018 and 11.02.2019 of this Court, the parties appeared before the trial Court on 02.03.2019 along with receipts of `15,000/- to get their statements recorded. Learned Chief Judicial Magistrate, Ferozepur, has submitted her report vide letter bearing No.130 dated 19.03.2019 duly forwarded by learned District and SONIKA 2019.05.09 16:30 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-33184 of 2018 --2-- Sessions Judge, Ferozepur, vide letter bearing No.3131/EB dated 29.03.2019.
According to the report, ld. Chief Judicial Magistrate, Ferozepur, is satisfied that the compromise entered into between the parties is genuine, voluntary and without any coercion, or undue influence. No accused has been declared as proclaimed offender. Considering the report of ld. Chief Judicial Magistrate, Ferozepur, dated 19.03.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.254 dated 28.11.2016 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
