Rajan Gupta, J (Oral) This is a petition under Section 438 Cr.P.C seeking pre-arrest bail in a case F.I.R No. 14 dated 3.2.2014 under Section 406 IPC registered against the petitioners at P.S., Amargarh, District Sangrur It appears while entertaining the petition a coordinate bench had directed the petitioners to furnish a bank guarantee in respect of amount due to the Corporation and stayed their arrest. Thereafter, several opportunities were granted to the petitioners to furnish the bank guarantee but they have failed to do so.
On merits, learned State counsel has opposed the plea. According to him, allegations against the petitioners are serious in nature and loss has been caused to the Corporation to the tune of Rs.42,63,059/-, which is public money.
Keeping in view the facts and circumstances of the case, I am of the considered view that petitioners are not entitled to the concession of pre-arrest bail. Petition is without any merit and is hereby dismissed. (Rajan Gupta) Judge March 12, 2015 BB
