(ORAL) Learned counsel for the petitioner submits that vide order dated 05.04.2021 (Annexure P-6) the petitioner has been granted the seniority in the Municipal Council from the date of joining the said institution i.e. 27.12.2017 instead of 27.04.2016 i.e. the date on which the order sending the petitioner to the Municipal Council on deputation was passed by the authorities.

Learned counsel for the petitioner further submits that the petitioner has already approached the authorities for bringing to their notice certain facts including the fact that similarly situated persons have already been granted the relief, which the petitioner is seeking for and the NARESH KUMAR 2021.06.28 16:18 I attest to the accuracy and integrity of this document

CWP-10166-2021 -2petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.1 to decide the representation dated 23.04.2021 (Annexure P-8).

Notice of motion.

Mr. Sharad Aggarwal, AAG, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State and raises no objection with regard to prayer of the petitioner for deciding the representation dated 23.04.2021 (Annexure P-8) by respondent No.1 in a time bound manner by passing an appropriate speaking order. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.1 is directed to decide the representation dated 23.04.2021 (Annexure P-8) by passing a speaking order within a period of three months from the date of receipt of a copy of this order.
