RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for setting aside the impugned orders dated 05.07.2019, Annexure P-2, passed by Sub Divisional Canal Officer, Odhan (respondent No.2) and order dated 14.11.2019, Annexure P-3, passed by Divisional Canal Officer, Rori (respondent No.3) and order dated 20.03.2020, Annexure P-4, passed by Superintending Canal Officer (respondent No.4) being illegal and arbitrary. It is further prayed to stay the operation of impugned orders, Annexures P-2 to P-4. It is also prayed that petitioner be compensated if respondent No.5 is provided Outlet through the land (eight marla) of the petitioner. Learned counsel for the petitioner has submitted that during pendency of the present petition, the parties have compromised the matter and hence the present petition may be disposed of as such. He has filed a MEENU 2023.12.14 12:21 I attest to the accuracy and integrity of this order/judgment

CWP-8884-2020 -2copy of the compromise, dated 15.08.2020, which is taken on record. It has been submitted by both the counsel that they have arrived at compromise in presence of the Gram Panchayat with their consent, as in accordance with the order passed by the Superintending Canal Officer. As per the compromise if Bhola Singh lay down the pipe line in Killa No.70 of Rectangle No.70 at his own cost, then Gurmail Singh would not have any objection.

Learned counsel for respondent No.5 has also affirmed the same.

As both the counsels are ad idem, the present petition is disposed of in view of the compromise arrived at between the parties and hence impugned order dated 20.03.2020 is modified accordingly. December 13, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
