MANJARI NEHRU KAUL, J. (Oral) Due to outbreak of COVID-19 pandemic, the case is taken up for hearing through video conferencing.
The present petition under Article 226 of the Constitution of India has been filed for a direction to the respondent to release the retiral dues of the petitioner accrued on his attaining the age of superannuation on 31.5.2004 along with interest at the rate of 18% per annum from the date of retirement till the payment is made.
Learned counsel submits that even though no disciplinary proceedings are pending against the petitioner as on date yet his retiral dues have not been released to him inspite of the representations made to the respondent authorities vide Annexures P-10 and P-11. Learned counsel for the petitioner at the outset thus submits that a direction be issued to the respondent for taking a decision on the representation (Annexure P10) submitted by the petitioner.

(respondent) to consider and decide the representation dated 18.12.2018 (Annexure P10) of the petitioner by passing a speaking order within a period of two months from the date of receipt of a copy of this order. In case after the decision of the representation (Annexure P10) the petitioner is found entitled for the benefits, the same be released to him within one month of the passing of the speaking order.
