IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-33226 of 2018 Date of Decision: 10.08.2018 Kanwaljit Kaur ....Petitioner
Versus
State of Punjab ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Anand Chhibbar, Sr. Advocate, with Mr. Vaihav Sahni, Advocate, for the petitioner. Mr. Harpreet Multani, AAG, Punjab.
Mr. Ateevraj Sandhu, Advocate, for the complainant. RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Kanwaljit Kaur in a case arising from FIR No.28 dated 06.03.2018 registered under Sections 420, 120-B, 467, 468 and 471 IPC at Police Station Dhariwal, District Gurdaspur (Punjab).
According to the prosecution, petitioner cheated public at large i.e. around 35 persons for Rs.2.90 crores on the false pretext of providing them job in the Education Department.
Learned counsel for the petitioner inter alia contends that no proof of payment of Rs.2.90 crores was produced by the complainant at the time of lodging FIR against the petitioner for providing job to him or other complainants. Petitioner is in custody since 06.03.2018. Final report under Section 173 has already been submitted in the Court. Conclusion of trial RAVINDER SINGH 2018.08.13 15:04 I attest to the accuracy and authenticity of this document may take a sufficient long time. No useful purpose would be served by keeping the petitioner behind bars.
-2CRM-M-33226 of 2018 On the other hand, learned State counsel has vehemently opposed the bail application.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on her furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
