The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to issue passport.

The petitioner was issued passport on 10.02.2005 which expired on 09.02.2015. An FIR No. 246 dated 05.12.2014, under Sections 382, 323, 148, 149 of IPC was registered against the petitioner at Police Station 'C' Division, Amritsar. The police after completing investigation filed cancellation report on 20.07.2016 which was not accepted by trial Court and matter was referred back for further investigation. Till date police has not filed report under Section 173 Cr.P.C. against the petitioner. Petitioner vide application dated 07.09.2022 applied for re-issuance of passport. Learned State counsel, on instructions from ASI Sukhbir Singh, does not dispute the aforesaid factual position. 4.

Learned counsel for Union of India submits that application of the petitioner has already been closed and if petitioner files fresh application it would be processed in accordance with law and after considering statement made by learned State counsel.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of with liberty to the petitioner to file a fresh application seeking passport. If petitioner files a fresh application, it would be disposed of expeditiously.
