Jaswant Singh,J.(Oral) Prayer is for grant of regular bail in case FIR No.423 dated 8.8.2015 under Sections 304-B/120-B IPC, PS Manimajra,Chandigarh. Daughter-Ritu of the complainant was married with one Bhoop Singh on 19.10.2008. From their wedlock a son was born who is presently four years old. Wife-Ritu has died in her matrimonial home allegedly an unnatural death. The viscera report is yet to be received. Petitioner is Devrani of the deceased residing in the same house in a joint family. During investigation role attributed to her is of active participation in administering some medicine perhaps resulting in her death.

CRM-M 32306/2015 in custody since 14.8.2015. She is stated to be pregnant with delivery date in early December whereas her 11 months' old son is also with her in judicial custody.

Learned counsel for the complainant stresses upon the role of the petitioner and therefore states that she is not entitled to grant of regular bail.

Learned Addl.PP on instructions from ASI Gurmeet Singh,PS Manimajra does not dispute the submissions made by learned counsel for the petitioner.

Without expressing anything on the merits of the case, keeping in view the physical condition of the petitioner as also the fact that investigations qua her are over, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Chandigarh.
