CHANDIGARH CRM-M-32319-2015 Date of Decision: September 21, 2015 Mandeep Singh

...Petitioner

Versus

State of Punjab

...Respondent

CORAM: HON'BLE MR. JUSTICE NARESH KUMAR SANGHI

Present:

Mr. A.K. Walia, Advocate, for the petitioner.

NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Mandeep Singh, son of Baldev Singh, resident of village Bhaini Bagha, District Mansa, who has been booked for having committed the offences punishable under Sections 120-B, 419, 420, 465, 467, 468, 471 and 474, IPC, in a case arising out of FIR No. 167, dated 3.9.2009, registered at Police Station, City, Mansa.

Learned counsel contends that the petitioner has been summoned under Section 319, Cr.P.C., by learned Trial Court, therefore, he is entitled to the benefit of anticipatory bail. I have heard learned counsel for the petitioner and with his able assistance gone through the material available on PRASHANT KAPOOR 2015.09.21 16:03 I attest to the accuracy and authenticity of this document

CRM-M-32319-2015 record.

As per the allegations, if read in conjunction with the summoning order passed under Section 319, Cr.P.C., by learned Trial Court, it appears that on the identification of a fake person as Amar Nath, by the petitioner, valuable document was attested. If the petitioner being a Sarpanch of the village, would not have identified the wrong person, then there was no occasion for the wrong doers to have committed the offence.

No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
