Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.98 dated 17.08.2016 under Sections 302, 34 IPC and Sections 25 and 27 of the Arms Act, registered at Police Station Amargarh, District Sangrur.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that the petitioners are named in the FIR. Only lalkara has been attributed and no injury has been attributed to them. Both the petitioners were found innocent during the investigation. CRM No.M-32359 of 2017 -2Now, the trial Court has summoned them under Section 193 Cr.P.C. The petitioners are not required for custodial interrogation or investigation. They are only to face trial before the Court. No useful purpose will be served by sending the petitioners to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where petitioners are entitled to benefit of anticipatory bail. Therefore, present petition is allowed. The petitioners are directed to appear before the trial Court within ten days from today and on doing so, they shall be released on bail by the trial Court to its satisfaction.
