Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to immediately accept the request of the petitioner for withdrawal of his resignation as Upper Division Clerk General in West Zone, PSPCL at Bathinda and to permit him to join on the said post, with all consequential benefits including arrears of salary and allowances for the period from the date of submission of his request for withdrawal of resignation dated 10.08.2022 (Annexure P-5) and to direct respondent No.3 to decide the legal notice dated 09.03.2024 (Annexure P-10) filed by the petitioner. 2.

Learned counsel for the petitioner at the outset submits that for claiming the relief in the present petition, the petitioner has also submitted a legal notice dated 09.03.2024 (Annexure P-10). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame. Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondent No.1 while Mr. Gagneshwar Walia, Advocate, has accepted notice on behalf of respondents No.2 and 3 and have no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.3 is directed to consider and decide the claim made by the petitioner in the legal notice dated 09.03.2024 (Annexure P-10), in accordance with law, by passing a speaking order, within a period of 02 months, from the date of receipt of certified copy of this order. 7.

The petition stands disposed of.
