Petitioner has filed this petition under Section 482 Cr.P.C. against respondents State of Punjab and Karnail Singh for quashing the FIR No.75 dated 19.05.2016 under Sections 177, 419, 420, 465, 467, 468 and 471 IPC registered at Police Station Sadar Jagraon, District Ludhiana and further quashing of proceedings arising therefrom. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that it is admitted fact that challan has already been presented and charges have been framed on 15.12.2016, which has been challenged in the present petition. The perusal of the record shows that report under Section 173 Cr.P.C. has not been placed on record nor any other statement or document collected during investigation, has been placed Vineet Gulati 2017.09.15 10:17 I attest to the accuracy and authenticity of this document Chandigarh on record.

CRM No.M-32404 of 2017 -2The perusal of the record shows that the trial Court has already found prima facie case and charges have been framed and those charges have not been challenged by the petitioner by filing revision petition for the last more than eight months and now this petition has been filed. Learned trial Court has already taken the cognizance. The perusal of the FIR shows that a cognizable offence is made out.

From the perusal of the record, I do not find anything on the record from where it can be held that the registration of the FIR is abuse of process of law or amounts to miscarriage of justice. Similarly, nothing has been placed on record to show that prima facie case is not made out. The present petition has been filed which is not supported by any cogent document on record.

Therefore, finding no merit in the present petition, the same is dismissed.
