(ORAL) By way of present petition filed under Section 439 CrPC, prayer has been made for grant of interim bail to the petitioner for a period of four weeks so as to meet his ailing father who is stated to be critical.

Being implicated in FIR No.119 dated 08.10.2022 registered under Sections 22(c), 61 and 85 of NDPS Act at P.S. Shimlapuri, District Ludhiana with alleged recovery of 1150 tablets of Alprazolem, the petitioner happens to be in custody for the last 1 year and 5 months. 3.

In the present petition, petitioner prays that his father is at the last stage of his life as he is suffering from blood cancer and liver enlargement besides swelling of abdomen and other ailments and thus interim bail be granted to him so as to take care of his father. 4.

Upon advance notice, Mr. Kewal Singh, Addl. A.G. Punjab on instructions from ASI Bachittar Singh submits that factum of ailment of father of petitioner has been verified and as a matter of fact, he is in a critical condition.

Granting interim bail in such circumstances is imperative as a compassionate measure that recognizes the humanitarian aspect of the situation. Allowing the petitioner to be with his critically ill father during his final moments would not only uphold the principles of human dignity and family values but also acknowledges the emotional and psychological support needed during such trying times. Additionally, it aligns with the fundamental right to life and personal liberty enshrined in Article 21 of Constitution of India, ensuring that individuals have the opportunity to be present with their loved ones during times of extreme distress.

Considering the aforesaid and taking a humanitarian view so as to enable the petitioner to see his father at the last stage of his life who is suffering from multiple serious ailments, the petitioner is granted concession of interim bail for a period of 6 weeks from the date of his release, subject to furnishing of adequate bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. 7.
