Keeping in view the averments made in the application, which are duly supported by an affidavit, the application is allowed. Delay of 10 days in re-filing the appeal is condoned.

Learned counsel for the appellant argues that certain arguments were raised before the learned Single Judge which were not considered while passing the order dated 16.01.2026, hence, the present appeal may kindly be disposed of having been not pressed, at this stage with liberty to file a review of the same before the learned Single Judge.
