RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Amrik Singh in a case arising from FIR No.70 dated 09.06.2017 registered under Sections 302, 379 and 34 IPC at Police Station Passiana, District Patiala. According to the prosecution, petitioner along with his son murdering Lal Singh sloen away two buffaloes, which the deceased had taken in the fields for grazing.
Learned counsel for the petitioner inter alia contends that petitioner has been falsely implicated on the basis of extra-judicial confession before Amrik Singh son of Joginder Singh, which is a very weak type of evidence. Petitioner is in custody since June, 2017. Conclusion of trial may take a long time. No useful purpose would be served by keeping the petitioner behind bars.
Learned State counsel has vehemently opposed the bail application.
