Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the death-cumretirement benefits arising out of the services rendered by the father of the petitioner, late Sh. Suraj Mohan, with respondent/department along with interest @ 9% per annum on the delayed payments. 2.

Learned counsel for the petitioner, inter alia, contends that the father of the petitioner had died in harness while serving the Nagar Counsil, Rampura Phul (respondent No.4) on 29.10.2025. The petitioner being the only surviving dependent is entitled to all death-cum-retiral

benefits of approximately Rs.19,63,242/- and also entitled to arrears of pay revision from 01.01.2016 to 30.06.2021.

Mr. Ankit Kumar, Advocate has put in appearance on behalf of respondent No.4 and file Memo of Appearance, which is taken on record. The Registry is directed to tag the same at appropriate place. 4.

Learned counsel for respondent No.4 submits that the death-cum-retiral dues of the father of the petitioner would be paid to the petitioner on or before 31.07.2026 with interest @ 6% per annum. Further, the arrears of pay revision from 01.01.2016 to 30.06.2021 would also be paid in terms of the schedule of payment approved by the Council of Ministers in its meeting dated 13.02.2025. 5.

In view of the stand taken by learned counsel for respondent No.4, the present petition is disposed of with a direction to the respondents to release all the death-cum-retiral dues of the father of the petitioner, to the petitioner on or before 31.07.2026, in the light of the judgment rendered by this Court in CWP-23651-2024 titled Surinder Singh and others vs. State of Punjab and others, decided on 12.03.2026. It is further directed that the arrears of pay revision from 01.01.2016 to 30.06.2021, which had fallen due up to 28.02.2026 in terms of the payment plan approved by the Council of Ministers on 13.02.2025, shall be released to the petitioner on or before 30.04.2026. All the delayed payments shall carry interest @ 6% per annum till the date of actual disbursement.

It is made clear that any deviation from the directions issued by this Court, would entitle the petitioner to move an appropriate application under Article 215 of the Constitution of India seeking initiation of contempt proceedings against the respondents.
