(ORAL) The instant petition has been filed under Section 438 of Cr.P.C., for grant of anticipatory bail to the petitioner who has been summoned under Section 319 Cr.P.C. in case FIR No. 136 dated 10.10.2017 under Sections 376, 384, 328, 509, 120-B, 201 of the Indian Penal Code and Section 66-E of Information and Technology Act, 2000, registered at Police Station City Kotkapura, District Faridkot.

Notice was issued in this matter and appearance has been caused on behalf of the respondent-State, who submits that the challan has been presented.

I have heard learned counsel for the parties and in view of the fact that after completion of the investigation challan has been presented and the petitioner has been summoned under Section 319 Cr.P.C., I deem it appropriate to stay the arrest of the petitioner for a period of one week and Satyawan 2018.08.23 14:02 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-33354-2018 in the meantime, the petitioner is directed to appear before the trial Court and furnish bail bonds and on doing so the trial Court shall release him on bail subject to its satisfaction. However, it is made clear that in case the petitioner does not appear before the trial Court within the stipulated period of one week any interim protection granted today shall stand automatically vacated.

Petition stands disposed of accordingly.
